PVUSD appeals ruling on vacant land
The Palos Verdes Peninsula Unified School District has appealed a trial court ruling that effectively prevented the district from selling two valuable undeveloped properties in a residential neighborhood of Palos Verdes Estates.
A Los Angeles Superior Court judge ruled in September that a deed restriction on the two adjacent properties – known as Lots C and D – was valid, meaning the land could only be used for school purposes or as a park. The school district had sued the quasi-governmental Palos Verdes Homes Association to get the 1938 restrictions ruled invalid.
The district wants to subdivide and sell the vacant land, which is on Palos Verdes Drive West and Via Pacheco, for as much as $2 million to $4 million.
The notice of appeal, filed Monday, comes just two weeks after the cash-strapped district narrowly won a $374 parcel tax measure that will bring in some $7 million annually. Both the parcel tax and the lawsuit have frustrated some residents.
The homes association issued a statement Wednesday questioning the use of district money to pursue further litigation, and saying it was “saddened” by the appeal.
